1. Acceptance of Terms

By using Southern Whale's services, you acknowledge that you have read, understood, and agree to these terms.

2. Services Provided

We provide the following services:

  • SEO services, Local SEO, SEO audits and SEO consulting
  • Google Ads
  • Website development, WordPress, e-commerce, hotel and clinic websites
  • Website migration to WordPress and website redesign
  • Software / web app development and system design
  • SEO courses and Vibe Code training

3. Payment Terms

  • 50% deposit required to start work
  • Remaining balance due before delivery
  • Payment methods: Bank transfer, Credit Card, PromptPay
  • Tax invoices available

4. Timeline and Delivery

Timeline depends on project scope as specified in the quotation. Delays must be notified at least 7 days in advance.

5. Warranty

  • Free bug fixes for 30 days after delivery
  • No Google ranking guarantee (depends on many factors)
  • No responsibility if client modifies code

6. Intellectual Property

After full payment and delivery:

  • Client owns Source Code
  • Client owns Content
  • We reserve right to showcase work in Portfolio

7. Cancellation

  • Before work starts: 100% deposit refund
  • During work: prorated based on progress
  • After completion: no refund

8. Limitation of Liability

We are not liable for damages caused by:

  • Google Algorithm changes
  • Hacking due to client negligence
  • Client's misuse
  • Force majeure

9. Governing Law

These terms are governed by Thai law. Disputes shall first attempt amicable resolution, failing which shall be submitted to Thai courts.

10. Free Services Before We Start (Website Audit and Draft)

Before any paid work begins, we audit your website and prepare a website draft for free, with no cost and no obligation to hire us.

  • Audit findings and drafts help you decide; they are not a guarantee of results or rankings
  • By requesting a free audit, you agree that we may publish the audit as a case study on our website
  • Case studies from free audits do not reveal your business name, website or any identifying details unless you give permission
  • If you do not agree to publication, tell us via LINE or email within 7 days of receiving the report; you can still ask us to remove it at any time after that
  • Website drafts remain our property until the project is hired and paid for under section 6
